Verdict on Jagan’s memo adjourned to April 27

Arguments on the memos filed by Kadapa MP YS Jagan Mohan Reddy and auditor Vijayasai Reddy were completed in the CBI special court, Nampally on Wednesday and decision was adjourned to April 27.

YSRCP president Jagan had filed a memo in the CBI court seeking directives to CBI to file only one charge sheet on all the charges against him since the investigating agency was not following the guidelines of the Supreme Court. Similarly, Vijaysai Reddy also filed a memo petition in the  CBI court for discharging him from the charges. 

Jagan’s senior counsel Susheel Kumar argued that how a Prevention of Corruption Act-11 was imposed against Jagan when he was not  a government employee.  Susheel Kumar stated that the inquiry should be unbiased and speedy as it was the right of every citizen. The CBI failed to fulfill the promises given to Supreme Court on the issue of charge sheets, the counsel said and added that the CBI had informed the Supreme Court that it would file only one charge sheet. The counsel also informed that he was ready to prove CBI’s promise to the SC.

Further arguing on the memo, Susheel Kumar said the CBI had mentioned in the FIR that the conspiracy took place between 2004 and 2009. He found fault with the CBI for showing different conspiracies while filing charge sheets. The counsel also brought to the notice of the court that the CBI had not mentioned when the conspiracy took place in the first charge sheet. The CBI should note down that there should not be different conspiracies and crimes in one FIR, Susheel Kumar argued.

He also reminded that the Supreme Court had delivered many judgements with one FIR, one charge sheet and one trial. Susheel Kumar said his client Jagan was in jail for more than 11 months, which was unfair and unjust. He argued that the CBI was deliberately delaying the investigation. It was unacceptable that the CBI was stating that the investigation was still continuing and at the same time it was filing charge sheets one after the other. Let the CBI to complete the investigation first and then go for other things, the counsel said. 

Susheel Kumar said Deloitte Sudarshan in CC-8 had given his testimony and the same was mentioned in two other charge sheets. How many times he would be quizzed as witness to mention in how many charge sheets, the counsel raised questions. 

Replying to the counsel’s arguments, Additional Solicitor General Ashok Bhan told the court that they had informed the Supreme Court that final charge sheet would be filed. But it did not mean that they would file only one charge sheet. Investigation has been taken up on seven issues and seventh charge-sheet would be filed after completing the probe. Later, a final charge sheet would be registered and the same had been informed to the Supreme Court, the AGP told the court. 

Meanwhile, the CBI filed a counter petition on the memos filed by Jagan and Vijaysai Reddy. The court adjourned the trial on discharge petition of Vijaysai Reddy to April 29.
