Demolition of Paturu Koteswara Rao Illegal Building Justified: CRDA

Paturu Koteswara Illegal Construction on River Krishna on Undavalli

Amaravati: Andhra Pradesh Capital Region Development Authority (CRDA), ) has said that strict action will be enforced on unauthorized constructions in Krishna River bed as per relevant provisions. Issuing a note about the demolition of an illegal building belonging to one Paturu Koteswara Rao, the CRDA had said that it had acted well within the provisions of law and the building had to be demolished as it had been constructed beyond the water course of Krishna River.

CRDA had issued notices to one Paturu Koteswara Rao under Section 115(1) and 116(1) on 06.06.2019 for unauthorized construction of a building with RCC Roof slab to a height of 0.3 M above ground level which is constructed in water course of Krishna River located in D.No.220/A1/B1, of site extent Ac. 5.06 cents in Undavalli village, Tadepalli Mandal, Guntur District.

As per the details mentioned in the Notice, the said construction was without any prior permission from Competent Authority and from River Conservator as per Sec 13 of River Conservancy Act (Andhra Area) 1884.

Paturi had replied in a letter dated 18-06-2019 contending that the said construction was made within their site to protect the concrete wall, which was constructed to stop erosion of land by the watercourse.

However after detailed consideration of their letter orders were issued on 19/9/2019 as the CRDA authority found that there was no merit in any of the grounds mentioned in his explanation and on 14-06-2019 orders were issued for demolition and initiated on 23/09/2019.

CRDA has issued provisional notices to 24 unauthorized constructions that are located along Krishna River. After detailed consideration of each of the contents of the owners, so far, for five buildings confirmation orders under 115(3) were issued along with speaking orders as the CRDA finds that there is no merit in any of the grounds mentioned in owner's explanation.

For remaining 19 constructions, the explanation submitted are under examination in which 5 cases need to be disposed complying the High Court Orders.
